JULY 2009: DON’T GIVE YOUR EMPLOYER AN EXCUSE TO TERMINATE*

With unemployment approaching 10% and employers shedding costs by shedding payroll at an alarming rate, employees at every level must be careful not to give their employer a reason to terminate them. Employers are looking for any excuse to cut there most expensive budget item (i.e, payroll) and therefore mundane acts such as showing up late to work, calling in sick and sending an occasional personal email are being used to justify terminations. Of greater concern, is that some employers are using such innocuous violations of company policy to claim cause which may cost employees both their right to unemployment insurance and severance under the company plan.

The best advice I can impart to my clients is to be hyper-vigilant with regard to your workplace conduct, err on the side of caution, confirm absences or other out of the ordinary matters in writing and do not take the safety of your position for granted no matter how valuable you believe you are.
